1. Platform Overview

Crafted Call is an online platform that connects artists with galleries, museums, and arts organizations through art call management, submission processing, jury coordination, and artwork sales. Our services include:

• Call for art creation, publishing, and management
• Artist submission and portfolio tools
• Jury review and scoring systems
• Exhibition and catalog management
• Payment processing for fees and artwork sales
• Communication tools between parties

2. Eligibility

To use Crafted Call, you must:

• Be at least 16 years old
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our services under applicable law
• Provide accurate, complete registration information

Organizations must be legally authorized to conduct business and enter contracts.

3. Account Responsibilities

Account Types

• Artist Accounts: For discovering calls, submitting artwork, tracking submissions, and selling work.
• Organization Accounts: For creating calls, managing submissions, coordinating juries, and processing sales.
• Juror Accounts: For reviewing and scoring submissions assigned by organizations.

Your Responsibilities

You agree to:

• Provide and maintain accurate account information
• Keep your login credentials secure and confidential
• Notify us immediately of unauthorized access
• Accept responsibility for all activity under your account
• Not share account access with others (except authorized team members for organizations)

4. Acceptable Use

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Submit fraudulent, misleading, or false information
• Harass, abuse, threaten, or discriminate against others
• Upload malware, viruses, or harmful code
• Attempt to gain unauthorized access to accounts or systems
• Scrape, crawl, or use bots without written permission
• Circumvent fees, payments, or security measures
• Interfere with platform operations or other users
• Use the platform for spam or unsolicited communications
• Impersonate others or misrepresent your affiliation

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Content & Intellectual Property

Your Content

You retain all ownership rights to content you upload (artwork, images, descriptions, etc.). By uploading content, you grant Crafted Call a non-exclusive, worldwide, royalty-free license to:

• Display your content within the platform
• Share content with organizations and jurors you submit to
• Create thumbnails and optimized versions for display
• Feature your work in marketing (with attribution, unless you opt out)
• Store and back up your content

This license ends when you delete your content, except where copies have been shared with organizations or are required for legal purposes.

Content Requirements

All content must:

• Be your original work or work you have rights to share
• Accurately represent the actual artwork
• Not contain illegal, harmful, or offensive material
• Not infringe on copyrights, trademarks, or other rights
• Comply with individual call requirements

DMCA & Copyright Claims

If you believe content on Crafted Call infringes your copyright, send a notice to email us including:

• Identification of the copyrighted work
• Location of the infringing content on our platform
• Your contact information
• A statement of good faith belief the use is unauthorized
• A statement under penalty of perjury that your notice is accurate
• Your physical or electronic signature

Our Content

The Crafted Call platform, including design, features, code, trademarks, and documentation, is our property and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform without written permission.

6. Fees & Payments

Fee Structure

• Subscription Fees: Monthly or annual fees for organization accounts, based on selected plan.
• Call Activation Fees: One-time fee to publish a call for art.
• Submission Fees: Fees set by organizations and paid by artists. Organizations receive these fees minus platform fees.
• Platform Fees: Per-submission fees and sales commissions as outlined in your plan.
• Payment Processing: Standard Stripe fees apply (currently 2.9% + $0.30 per transaction for US cards).

Payment Terms

• All fees are in US Dollars unless otherwise stated
• Payments are processed through Stripe
• Subscription fees are billed in advance
• You authorize recurring charges for subscriptions
• Failed payments may result in service suspension

Refund Policy

• Submission Fees: Generally non-refundable once submitted. Organizations may issue refunds at their discretion.
• Call Activation Fees: Non-refundable once the call is published.
• Subscription Fees: No refunds for partial months. You may cancel anytime and retain access through the end of your billing period.
• Artwork Sales: Refunds for artwork purchases are handled between the artist/gallery and buyer according to their stated policies.

We may issue refunds in cases of platform error, duplicate charges, or at our discretion. Contact email us for assistance.

7. Organization Responsibilities

Organizations using Crafted Call agree to:

• Provide accurate call information and requirements
• Honor stated deadlines, fees, and selection criteria
• Communicate selection results in a timely manner
• Handle artist data responsibly and in accordance with law
• Not discriminate based on protected characteristics
• Maintain appropriate insurance for exhibitions and events
• Handle artwork with reasonable care
• Process artist payments promptly for sales

Crafted Call is a platform connecting artists and organizations. We are not responsible for organizations' selection decisions, exhibition practices, or handling of artwork.

8. Disclaimers

Service Availability

Crafted Call is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• That defects will be corrected
• That the platform is free of viruses or harmful components
• The accuracy of third-party content

No Guarantee of Selection

Submitting to a call does not guarantee selection, exhibition, or any particular outcome. Selection decisions are made solely by the organizing entities, not by Crafted Call.

Third-Party Links

Our platform may contain links to third-party websites or services. We are not responsible for their content, policies, or practices.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTED CALL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Damages resulting from unauthorized access to your account
• Actions or omissions of organizations, artists, or other users
• Content posted by users
• Service interruptions or errors

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow limitation of liability for certain damages, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Crafted Call and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or share
• Your interactions with other users

11. Termination

By You

You may delete your account at any time through your account settings or by contacting support. Deletion will cancel any active subscriptions at the end of the current billing period.

By Us

We may suspend or terminate your account at any time, with or without cause or notice, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended inactivity
• Requests by law enforcement

Effect of Termination

Upon termination:

• Your right to access the platform ends immediately
• You remain liable for any outstanding fees
• Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution survive termination

12. Dispute Resolution

Informal Resolution

Before filing a formal dispute, you agree to contact us at email us and attempt to resolve the matter informally for at least 30 days.

Arbitration Agreement

If informal resolution fails, any dispute arising from these Terms or your use of Crafted Call shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in New Hampshire, USA, or remotely if permitted.

Class Action Waiver: You agree to resolve disputes with us on an individual basis. You waive any right to participate in class actions, class arbitrations, or representative actions.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access. Small claims court actions are also permitted.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or platform notice at least 30 days before taking effect. Your continued use after changes constitutes acceptance.

If you disagree with changes, you may close your account before they take effect.

14. General Provisions

Governing Law

These Terms are governed by the laws of the State of New Hampshire, USA, without regard to conflict of law principles.

Entire Agreement

These Terms, along with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and Crafted Call.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

Assignment

You may not assign your rights under these Terms. We may assign our rights to an affiliate or successor.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, or government actions.
